This Gore Privacy Notice describes how W. L. Gore & Associates, Inc. and its affiliate and subsidiary companies globally (together, “Gore”, “we”, “us”, “our”) process personal information which is subject to applicable laws.

This Privacy Notice applies to our processing of personal information about: -

  1. Information collected via websites - users of our websites, including associated pages and online services, that display this Privacy Notice (the “sites”), 
  2. Information from our customers - personal information about our former, current, and prospective customers and others with whom we do or have done business, 
  3. Information from our vendors and service providers - personal information about our former, current, and prospective vendors and service providers with whom we do or have done business, 
  4. Information in any other capacity that you engage - others who engage with us regarding our products or services or otherwise communicate with us. 

It does not apply to the personal information we collect from our associates or applicants for employment.


Information We Collect

Directly from You 

Customer Service and Support 

Gore may collect personal information directly from you, such as when you, contact us online, when you visit our sites or locations or when you email, call, or otherwise contact us. We maintain records about our interactions and communications with you. The information that we collect will vary depending upon the context of your contact, but for general inquiries, we require your first and last name and contact information, such as address, telephone number and email address. 

Comments and Content 

Some of our other sites may allow you to comment, share or post other content. We may keep a record of this content and it may be viewable by other users of the sites. You may ask us to remove such content. 

E-Commerce 

When you purchase products from us directly from our online stores we require additional information, such as billing and delivery address, and bank and/or credit card details to process your orders.

We may also collect personal information from other sources. We work with external professionals, contractors, suppliers, experts, consultants, and others in the operation of our business. We also engage with customers and partners related to the provision of our products and services. We collect information such as

Disclosure of Information

Gore is a global enterprise that consists of various entities worldwide. To facilitate Gore’s global operations, personal information may need to be shared with and transferred between Gore affiliates. Gore affiliates may access and use your personal information as described in this Notice.

With the exception of certain information collected by Gore's SITKA® Gear brand, Gore does not sell your personal information to third parties. For information on Gore's privacy practices in connection with its SITKA® Gear brand, please see the SITKA® Gear Privacy Notice.

If necessary to achieve the notified purpose, we may disclose personal information to other affiliates and third parties, for example:

  • Agents and distributors
  • Sales partners or suppliers
  • IT service providers
  • Regulators, law enforcement, government authorities, or attorneys and consultants

International Transfers

As a global company, we may transfer your personal information to, access or store it in jurisdictions outside of your home jurisdiction, in which we (or our service providers) operate.

Some of these jurisdictions may not provide equivalent levels of data protection as your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection comparable to the protection under applicable law in the jurisdiction from which we collect such personal information, including through appropriate written data processing terms and/or data transfer agreements.


Security

We have implemented organizational, technical, and physical security measures to protect your personal information under our control. While the security safeguards we have put in place are routinely reviewed and updated, the security of any data transmissions and data storage systems cannot be completely guaranteed.

Retention

In accordance with our data retention practices, we will retain your personal information as long as needed to fulfil the purposes outlined in this Notice, and as otherwise necessary to fulfil our legal obligations, resolve disputes, maintain appropriate business records, enforce our agreements or for such longer period as required by applicable law. The retention period depends on the type of information and the purpose for which it was collected.

This Notice does not address, and we are not responsible for, the privacy practices, information collected, or other activities and practices of any third parties. The inclusion of a link on the website does not imply endorsement or recommendation of the linked site by us or by our affiliates.

In some cases, we may permit you to use third-party payment services to make payments. If you wish to make a payment using a payment service, you will be directed to a webpage that is hosted by the payment service and not by us. Any information that you provide through this page will be subject to the applicable payment service’s privacy policy, rather than this Notice. We do not have control over, and are not responsible for, any payment service’s use of information collected through any payment service page.


Use of Website by Minors

Our sites are not directed towards minors and we do not encourage minors to participate in providing us with any personal information. We do not knowingly collect any personal information from minors without verifiable parental consent. If you have reason to believe that a minor, without a parent or guardian's consent, has provided personal information to us through the sites, please contact the Gore Privacy Office. We will take steps to delete the information as soon as possible should we learn that we have collected the personal information of a minor without first receiving verifiable parental consent.


Your Rights

Gore takes reasonable steps to keep your personal information accurate, up to date and complete.

Under certain circumstances and subject to applicable law, you may have a right to request access to, correction of, or deletion of, your personal information. In some circumstances, you may request that we cease using or sharing personal information about you with our business partners or Gore Affiliates. You may also have the right to withdraw your previously given consent or change the scope of the given consent.

We will endeavor to make the required updates and changes within the time specified by applicable law. Where permitted by law, we may charge an appropriate fee to cover the costs of responding to the request.

Changes to this Privacy Notice

We may update this Notice from time to time to reflect changes and will indicate changes by posting the new version of this Privacy Notice (and effective date) on this website. We encourage you to periodically review this website and our Privacy Notice to understand how Gore protects your personal information. Once effective, the revised Privacy Notice will apply to you and your personal information.


Additional Information for France - Studies Using the SNDS Database

When we conduct studies using the French Health database SNDS (Système National des Données de Santé), we are required to inform the people concerned that they have the rights of access to, rectification of and objection to the use of their personal data. These rights are exercised with the director of the health Insurance center administering the mandatory health insurance plan to which the persons are attached, in accordance with the National Law (article R. 1461-9 of the French Code de la Santé Publique).

The following information applies to personal data which we process from any individual that is related to Japan under the Act on the Protection of Personal Information (APPI).

Third Party Provision

We will not provide or disclose personal information to a third party without the consent of the individual, except in the case of provision to entrusted parties and joint use. However, this does not apply in the following cases;

(1) Based on Laws and Ordinances

(2) When it is necessary for the protection of human life, body or property, and it is difficult to obtain consent of the person himself/herself.

(3) When it is particularly necessary for improving public health or promoting healthy development of children and it is to obtain the consent of the person himself/herself.

(4) In cases which there is a need to cooperate in regard to public institutions such as police and courts performing affairs prescribed by laws and regulations, and when there is a possibility that obtaining a principal's consent would interfere with the performance of the said affairs.

The LGPD requires us to provide you with information on the legal basis for processing your personal information. Gore processes your personal information on the following basis:

  • Contract Performance (Article 7 V LGPD)

Additional Information for China

Legal Basis of the Processing Without Consent

We will not provide or disclose personal information to a third party without the consent of the individual, except in the case of provision to entrusted parties and joint use. However, this does not apply in the following cases.

(1) When it is necessary to conclude or perform the contract at your request.

(2) When it is necessary for the performance of statutory duties or obligations, such as those directly related to national security, national defense security, criminal investigation, prosecution, trial and execution of judgments, etc.

(3) When it is particularly necessary for improving public health or the protection of human life, health, or property in an emergency.

(4) In cases where there is a need to process personal information already disclosed by yourself or otherwise lawfully disclosed, within a reasonable scope in accordance with the provisions of the relevant laws.

(5) When it corresponds to the reason permitted by relevant laws and regulations.

To the extent required by Chinese laws, we will use your personal information for marketing purposes only after obtaining express consent from you.

Security

In case of personal information security incidents, we will activate emergency plans to prevent the expansion of security incidents and inform you by emails, push notifications, announcements, and other forms, in a timely manner and in accordance with laws and regulations.

Your Rights

If you are a resident of mainland China, you may have the following rights under the Personal Information Protection Law (PIPL) in relation to personal information that we hold about you:

  • Right to access to and copy your personal information;
  • Right to withdraw your consent to processing your personal information; however, the withdrawal will not impact any processing before the withdrawal;
  • Right to require correction or supplementation if it is inaccurate or incomplete;
  • Right to require deletion of your personal information where:
  • such personal information is no longer required to achieve the purpose for which it was collected;
  • Gore has ceased to offer the products or services, or the retention period for the data has expired;
  • you have withdrawn your consent and the processing is based on your consent;
  • Gore has processed personal information in violation of Chinese laws or regulations, or in breach of this Privacy Notice;
  • other circumstances provided by Chinese laws or administrative regulations that apply;
  • Right to request us to interpret the personal information processing rules;
  • Right to request us to transfer your personal information to another party designated by you according to Chinese laws; and
  • Any other rights provided under PIPL.

Disclosure of Information

We may also share the personal information about you:

  • with our trusted service providers who work on our behalf – such service providers do not have an independent use of the information we disclose to them and have agreed to adhere to rules and standards substantially similar to those set forth in this Privacy Notice; or
  • if we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of this information, as well as any choices you may have regarding your personal information.

International Transfers

In due course, we will publish a list of the recipients to whom we transfer personal information outside of mainland China, their contact details and details on what, how and why such recipients process your personal information. Destruction of Personal Information

(1) Procedure for destruction

  • Following the achievement of the purpose of processing, your personal information will be destroyed after being stored for a certain period in accordance with reasons for information protection under internal policy and other relevant laws (processing and storage period).

(2) Method of destruction

  • The personal information printed out in paper shall be shredded or destroyed by burning, and personal information stored in an electronic file shall be deleted by using a technology allowing no reproduction of records.
